Terms and concessions

What you buy

A concession is the right to use a space (Nicchia, Alcova or Sacello) for a chosen duration — ten, twenty, fifty years or forever — with a single payment, not a subscription. The Targa is free and has no expiry.

Long-term custody — what happens at expiry

We notify you, and the notification contacts you've named, twelve, six and one month before. If no one renews, the showcase enters dormant mode for five years: it stays viewable read-only, can no longer be edited, and receives no new thoughts. After five years it's archived: no longer reachable by the public but preserved, and whoever has standing (curator, notification contact, family member) can ask for it to be reactivated with a new concession, or exported. We never delete a showcase simply because time has passed.

If we were to cease operating before expiry

This is a scenario we have to plan for honestly, not one we expect. In that case we commit to: notifying you, and your notification contacts, at least twelve months in advance — or, if the cessation isn't up to us, the maximum notice possible; keeping full showcase export available throughout that notice period, in an open format readable without our software; refunding the portion of the price corresponding to the years not enjoyed, in proportion to the remaining duration; proposing, if one exists, a party willing to take over conservation on the same terms, which you may accept or decline. These commitments don't exclude the other rights the law gives you for non-performance.

Export at any time

You don't have to wait for a problem: at any time you can download a full copy of the showcase with "Download a copy". It's the one guarantee that depends on no one, not even us, and we recommend using it periodically.

What we don't change

Duration, expiry conditions and our commitments in case of cessation can't be changed for the worse for concessions already purchased. Any improving changes apply to you too. Other changes are communicated by email at least sixty days in advance and, if you consider them detrimental, you can withdraw with a proportional refund of the remaining duration.

Ownership and content

Whoever creates a page for a loved one declares to have the standing to do so. Uploaded content (photographs, text) remains the property of whoever wrote or photographed it: you share it with Atrahasis only to show it in the showcase.

Joint controllership

For public showcases and for messages delivered to third parties, the curator and Atrahasis are joint controllers of the processing (GDPR art. 26). The curator answers for the lawfulness of the data they enter and the reasons they know it; Atrahasis answers for security, for informing people named in the content, for handling their requests, and for communications to third parties. Data subjects can exercise their rights against either of us; the single point of contact is the Contact page. For private showcases, the curator acts within a personal activity and Atrahasis is the controller only for the processing necessary to provide the service.

Family members named in the family tree

By entering the details of living family members in the family tree, the curator declares they have a legitimate reason to do so and accepts that a person so named may ask for removal or non-public status, which Atrahasis will carry out right away, without the curator being able to object. While a doubtful case is being clarified (for example: a family member claims to be deceased, the curator claims otherwise), the entry stays non-public.

Conflict between relatives over a showcase

Whoever has a real connection to the remembered person can dispute a specific piece of content or the whole showcase, even if they aren't the curator. We notify whoever curates the showcase right away, and they have 15 days to respond; we decide within 30 days of the request regardless, up to 2 more months in more complex cases. If the dispute concerns the whole showcase, we make it private for the duration of the review: we never remove it against the curator's will. Atrahasis doesn't decide who is right between the parties: we carry out what they agree between themselves, or what an authority orders — the data protection authority, a judge, or civil mediation under Legislative Decree 28/2010.

What can't be on Atrahasis

Unlawful content; defamation; data or images of people who haven't given permission, except as set out for the family tree; commercial content; material not relevant to the remembered person's memory.

Who moderates

Thoughts and testimonies left by visitors appear only after the curator approves them. By approving a thought or testimony, the curator authorizes its publication under their own responsibility. Atrahasis doesn't review content before it's published: we step in on a report, through "Report", or on a request from an authority, reviewing diligently, objectively and proportionately, and we can remove content the curator already approved without the curator being able to oppose it. We don't use automated tools to decide.

What we do

We can make a piece of content non-public, remove it, or in serious cases suspend an account. Whoever published it always receives a written explanation and can contest it by writing from the Contact page. Every decision is logged. Whoever has standing can request the removal of an entire page through the Removal procedure, a separate, more formal channel.

Right of withdrawal

If you are a consumer, you can withdraw from the contract within 14 days of it being concluded (the day you receive the order confirmation email), without giving any reason.

How to exercise withdrawal

Send an explicit statement from the withdrawal page reachable from your showcase or from the confirmation email, or fill in the withdrawal form available below and send it to us via the Contact page. The form isn't mandatory. The deadline is met if your statement is sent before the 14 days expire. We will confirm receipt by email without delay.

Effects of withdrawal

We will refund the amount paid within 14 days of receiving your statement, using the same payment method you used, at no cost. If you asked for custody to start right away at the time of the order, we will keep only the share corresponding to the days the service was active, calculated in proportion to the concession's duration — for perpetual concessions nothing is kept back. If you didn't ask for immediate start, the showcase isn't activated before the 14 days expire and the refund is full.

What happens to the showcase

Withdrawal removes the showcase and all its uploaded content for good, including genealogy, memories, recordings and messages. This is the only case in which Atrahasis deletes content: the general "no automatic deletion" rule doesn't apply to a contract you've withdrawn from. Before withdrawing you can export a full copy from your showcase. Messages already delivered to third parties (letters through time, unspoken words) can't be recalled.

Echo's endowment and additional services

The same rules apply to later purchases (the Echo's endowment, concession extensions): 14 days from purchase, with a proportional deduction for hours already used if you asked for immediate activation.

After the 14 days

Once the deadline has passed, the concession is not refundable. Your rights if the service isn't delivered as promised remain unaffected.
